Appealing an international protection decision

You can lodge an appeal on your International Protection application to the Tribunal of Asylum Returns Appeals (TARA).

Appealable Decisions

Decisions that can be appealed

The Tribunal for Asylum and Returns Appeals has jurisdiction to determine appeals against the following decisions relating to the grant of international protection:

  • Decisions to reject an application as inadmissible
  • Decisions to refuse Refugee Status only
  • Decisions to refuse both Refugee and Subsidiary Protection Status
  • Declarations to implicitly withdraw an application status
  • Return decisions (these are decisions made under section 216 and 218 of the International Protection Act 2026)
Legal Support

Legal representation during an appeal

You can also request a legal representative free of charge from the Legal Aid Board during your appeal.

The legal representative will assist you with lodging your appeal, preparing for your appeal and will attend the appeal hearing on your behalf where there is an oral hearing.
